Terms & Conditions
Welcome to EBA Logistics LLC. By utilizing our transportation, warehousing, or freight management services, you agree to comply with and be bound by the following detailed terms and conditions. Please read them carefully.
1. Services Provided: EBA Logistics LLC agrees to provide transportation, freight forwarding, and warehousing services as strictly agreed upon in the individual bill of lading, rate confirmation, or service contract. Any modifications to the scope of service must be documented and agreed upon in writing.
2. Liability & Insurance: Our liability for lost, delayed, or damaged goods is strictly limited to the federal standard requirements and our carrier liability limits unless a higher declared value is agreed upon in writing prior to shipment dispatch. EBA Logistics LLC maintains comprehensive cargo and liability insurance, but we strongly advise clients to secure supplemental insurance for high-value freight.
3. Payment Terms: Invoices are generated upon proof of delivery and are strictly due within 30 days of receipt, unless alternative credit terms have been formally established and approved by our finance department. Late payments are subject to a 1.5% monthly interest rate, plus any associated collection fees.
4. Reverse Logistics & Refused Freight: Goods processed for return, disposal, or freight refused at the receiver will be handled according to strict environmental and state regulations. The shipper is responsible for any additional accessorial charges incurred due to detention, redelivery, or disposal. EBA Logistics LLC is not responsible for the inherent condition of returned merchandise.

Refund Policy
Due to the complex operational costs, fuel expenses, and capacity commitments inherent in freight and warehousing, our refund and cancellation parameters are strictly defined to ensure fairness and efficiency.
Service Cancellations: If a load pickup is canceled by the shipper or broker at least 24 hours prior to the scheduled dispatch, a full refund of any prepaid deposit will be issued. Cancellations made within 24 hours of the scheduled pickup are subject to a standard Truck-Order-Not-Used (TONU) fee of $150 to $250, depending on the equipment type reserved.
Freight Claims: Refunds or adjustments for damaged, shorted, or lost goods are not handled as standard financial refunds. They must be processed through our formal freight claims procedure as dictated by the Department of Transportation and the Carmack Amendment. Claims must be filed in writing within 9 months of delivery.
Billing Disputes & Overcharges: If a rate auditing error results in a billing overcharge, EBA Logistics LLC will conduct a thorough review. Upon verification, we will refund the exact difference to the original payment method or issue a credit memo within 7-10 business days.
